Impulse
originally filed suit against Nintendo, EA, Ubisoft, THQ, Konami, Majesco and
Namco Bandai claiming infringement of patent for an, “interactive system
measuring physiological exertions.” The
complaint outlined that fitness titles such as “EA Sports Active Personal
Trainer” and peripherals such as the “Wii Fit Plus” and the “Wii Balance Board”. On October 23, 2012, the case was dismissed
with prejudice as to all claims against the game developers but without
prejudice as to all claims made by the defendants against Impulse.
